6. Benefits to Port St. Lucie: The City and FDOT desires to provide an Incentive/Disincentive Provision in the construction contract to complete the construction of Port St. Lucie Boulevard Segment 2.2 (South of Paar Drive to South of Alcantarra Boulevard) sooner for the benefit of the public, safety, and to reduce the disruptive effect of construction on the community. This amendment to the Locally Funded Agreement (LFA) allows the City to provide the required additional funding to FDOT, per the terms of the original LFA. The total Project cost is estimated to be Twenty-Three Million Nine Hundred Fourteen Thousand One Hundred Six Dollars and no Cents ($23,914,106.00). Per the conditions of the original LFA, in the event the actual cost of the project is greater than that paid by the City, the City shall be responsible to pay the difference to the FDOT. On December 6, 2023, FDOT received Three Million Five Hundred Forty-Eight Thousand Six Hundred Nineteen Dollars and No Cents ($3,548,619.00) from the City for the Project’s construction services. The Incentive/Disincentive Provision increases the actual Project construction cost by Three Hundred Thousand Dollars and No Cents ($300,000.00); therefore, the City is required to pay this difference to FDOT.
7. Cost to Port St. Lucie (Annual and Potential): The City’s cost for this Amendment is Three Hundred Thousand Dollars and No Cents ($300,000.00).

Staff Recommendation: Move that the Council approve the resolution for the Locally Funded Agreement Amendment Number One.

Background: The St. Lucie County Transportation Planning Organization (TPO) has designated federal funding from the Federal Highway Administration for the design, permitting, acquisition of property rights, and construction of public improvements on Port St. Lucie Boulevard from South of Paar Drive to South of Alcantarra Boulevard. In accordance with Florida Statutes and Federal funding provisions, FDOT is authorized to manage the federally funded project on behalf of the City. The project improvements include widening the road from two to four lanes including sidewalks, lighting, drainage, traffic signals, and landscaping. On December 6, 2023, the State of Florida Department of Transportation (FDOT) and the City of Port St. Lucie entered into a Locally Funded Agreement to provide FDOT financial assistance for the construction services in connection with the project. On December 6, 2023, FDOT received the City’s financial contribution of Three Million Five Hundred Forty-Eight Thousand Six Hundred Dollars and No Cents ($3,548,619.00), as required by the LFA. In an effort to reduce the construction time and minimize the construction impacts to the community, the City and FDOT desires to include an Incentive/Disincentive Provision to the construction contract, which increases the project construction costs. The City’s share for the construction services has increased; therefore, the City is required to pay the additional amount of Three Hundred Thousand Dollars and No Cents ($300,000.00). The roadway construction is in FDOT’s FY 2024-2028 5-year work program and is being scheduled for Letting this year (2025).
Issues/Analysis: Per the terms of this Amendment, the City must furnish FDOT with a check or a wire transfer in the amount of Three Hundred Thousand Dollars and No Cents ($300,000.00), within thirty (30) days of executing the Amendment. In the event payment is not received by FDOT within thirty (30) of execution of the Amendment, FDOT reserves the right to suspend the project’s construction services until the additional funding is received.
Financial Information: The estimated total construction cost is Twenty-Three Million Nine Hundred Fourteen Thousand One Hundred Six Dollars and no Cents ($23,914,106.00). Under the LFA, the City is responsible for Three Million Eight Hundred Forty-Eight Thousand Six Hundred Nineteen Dollars and No Cents ($3,848,619.00). The City made a previous payment of Three Million Five Hundred Forty-eight Thousand Six Hundred Nineteen Dollars and No Cents ($3,548,619.00) on December 6, 2023. The additional amount due to FDOT is Three Hundred Thousand Dollars and No Cents ($300,000.00).
Special Consideration: This Amendment is required so that the City can provide FDOT with the additional funds for construction services in connection with the reconstruction of Port St. Lucie Boulevard from South of Paar Drive to South of Alcantarra Boulevard.
