Summary Brief (Agreements/Contracts only)
1. Prepared by: Robyn Holder, CPPB (PMD).
2. Parties: City of Port St. Lucie and Ferreira Construction Co., Inc.
3. Purpose: To construct all necessary infrastructure for the “WOW” Park on Westmoreland Blvd.
4. New/Renewal/Modified: Modified.
5. Duration: An additional 201 calendar days are required for the additional scope of work. New proposed end date is February 23, 2024.
6. Benefits to Port St. Lucie: To provide a premier destination within the City of Port St. Lucie. This area will bring a diverse array of recreation and leisure opportunities for all to enjoy.
7. Cost to Port St. Lucie (Annual and Potential): An additional $733,274.44 for Amendment #4 and an additional $1,373,636.38 for Amendment #5. The new Contract amount is $12,047,309.79.

Staff Recommendation: Move that the Council approve Amendments #4 & #5 to Contract #20220032 for The Port District - Park & Playground Infrastructure Improvement Project with Ferreira Construction Co., Inc. Both Amendments are requested to be processed at the same time to separate the funding sources.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Amendments #4 & #5 to Contract #20220032.
2. Move that the Council not approve the Amendments and provide staff with direction.
Background: The Westmoreland Middle Tract has long been identified as a unique gathering place along the North Fork of the St. Lucie River. Recent efforts to improve the visitor experience include the installation of a boardwalk along the river, in addition to continued improvements to the City’s Botanical Gardens.
The project was bid in February of 2022 and was awarded to Ferreira Construction Co., Inc., on June 13, 2022.
Amendment #4 includes field adjustments to the site for additional underdrains & yard drains, potable water lines & valve pads, existing load center & electrical pull boxes, delays by FP&L for power service, ADA requirements on the boardwalk, three (3) more steps & associated handrails around the stage, pavement & concrete at the entrance, curb ramp along internal roadway, rip-rap slope at new retaining wall, handrail on gravity wall and a credit for poured-in-place surfacing verses turf.
Amendment #5 includes the construction of the boardwalk under Port St. Lucie Blvd. that will connect the north and south sections. Previously, FDOT was working in that area and requested the City hold construction until they completed with their work. FDOT has run into issues with their contractor and is no longer requiring the City to wait. This is the opportune time to begin construction immediately.
Issues/Analysis: Staff has reviewed the proposed changes and additions to the scope of work and find them to be fair and reasonable for the work required.
Financial Information: Funds are appropriated in Parks & Recreation CIP Fund / Parks & Recreation / Improvements O/T Building (#301-7210-563000-22PR001P).
