Executive Summary (General Business): Grant of Easement over VGTI driveway for benefit of Parcel 3 of Southern Grove Plat No. 8, which is currently subject to a Purchase and Sale Agreement with Cleveland Clinic.
Presentation Information: Questions will be answered upon request.
Staff Recommendation: Move that the Council approve the Access Easement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Access Easement.
2. Move that the Council not approve the Access Easement.
Background: The City of Port St. Lucie holds title to the VGTI driveway property, and GFC currently holds title to Parcel 3 of Southern Grove Plat No.8.
Issues/Analysis: Port St. Lucie Governmental Finance Corporation (“GFC”) and Cleveland Clinic entered into a Purchase and Sale Agreement (the “PSA”) in February of 2021 for Cleveland Clinic’s purchase of Parcel 3 of Southern Grove Plat No.8. Pursuant to an amendment to the PSA (attached as Attachment 1) the GFC agreed to extend the existing the easement over the VGTI driveway to Parcel 3 of Southern Grove Plat No.8. Cleveland Clinic is scheduled to purchase Parcel 3 of Southern Grove Plat No. 8 in July of 2022. The existing easement over the driveway for access, drainage and utility purposes recorded in OR Book 3101, Page 73 of the St. Lucie County, Florida Public Records.
Financial Information: This easement modified the allocation the Costs between the benefitted parcels as there are now additional benefitted parcels.
