2. Move that the Council not approve the Ordinance and provide staff with direction.
Background: The City owns property located at 2454 SE Westmoreland Blvd, more commonly known as The Port District Riverfront Park and Pioneer Park. This area was formerly known as the Westmoreland Middle Tract. The City is currently constructing The Port District Riverfront Park improvements, which require electrical service to be run to and through the site. The project team is seeking the Council’s authorization to convey an easement to FPL to power site. The easement is more particularly described in the attached exhibits.
Issues/Analysis: This conveyance is necessary to run power to The Port District Riverfront Park and related amenities.
Financial Information: There is no cost for conveying the easement. The cost of the work performed is encumbered under The Port District - Park & Playground Infrastructure and Improvement Project (PPIIP) contract with Ferreira Construction (#20220032).
Special Consideration: An easement is necessary to grant FPL the requisite interest in real property to provide power to The Port District Riverfront Park. FPL provided their form easement document, which is broad in scope and potentially requires removal of obstructions within the easement area, which could potentially include City infrastructure, if there is such infrastructure, within the easement area.
Location of Project: 2454 SE Westmoreland Blvd, generally known as The Port District Riverfront Park.
