Staff Recommendation: Move that the Council Move that the Council waive the bidding, per City Code of Ordinances, Section 35.08(a)(25)(a)(1) (sole source where the compatibility of equipment, accessories, or replacement parts is the paramount consideration), as there are no commercially available substitutes for these components and/or replacement parts, which can only be purchased from the manufacturer or distributor, and approve Contract #20270029 for the MFEC Elevator Modernization with Schindler Elevator Corporation.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Sole Source Contract #20270029.
2. Move that the Council not approve Sole Source Contract #20270029 and provide staff with direction.
Background: The MFEC parking garage has two original elevator systems that have been in service for approximately 20 years. Both elevators are currently out of service. Because of the age and condition of the equipment, replacement parts have become increasingly difficult to obtain, and repair personnel have confirmed that spare components are no longer available. As a result, the elevators can no longer be repaired and require full modernization.
Issues/Analysis: The proposed modernization by Schindler involves replacing key components while retaining and refurbishing elements of the existing Schindler-installed elevator systems. Using the original equipment manufacturer enables the City to preserve and reuse compatible components, resulting in significant cost savings that would not be achievable with another vendor. As the incumbent service provider, Schindler possesses comprehensive knowledge of the equipment’s configuration, performance history, and maintenance requirements. Engaging a new contractor would require time and resources for familiarization, introduce avoidable project risk, and create discontinuity between the modernization work and ongoing maintenance. Given the highly specialized nature of elevator systems, the scope of the refurbishment, and Schindler’s longstanding responsibility for maintaining the City’s equipment, their proposal represents a fair and reasonable price and aligns with the successful strategy used in comparable recent elevator modernization efforts within the City.
