Staff Recommendation: Move that the Council approve the requested Termination of Restrictive Covenant.

Background: On June 12, 2013, Larry D. Heimer and Mariko H. Heimer executed an Amended Restrictive Covenant relative to Lots 42 and 43 Block 1161, Port St. Lucie Section Twelve. The Amended Restrictive Covenant encumbers Lots 42 and 43 so that they would be assessed as a single residential unit.

Issues/Analysis: The current owners of the subject property wish to devise or develop Lot 43 independently of Lot 42. The administrative fee owed to the City has been paid in full. The Amended Restrictive Covenant may now be released, satisfied, and discharged in its entirety, and a Termination of Amended Restrictive Covenant shall be recorded with the St. Lucie County Clerk.

Financial Information: The sum of $200.00 was owed to the City of Port St. Lucie as an administrative fee. Payment in full was made on September 7, 2021 and was processed and approved by the City's Finance Department.
