Executive Summary (General Business): Approve and authorize the settlement of the above-referenced litigation ("Lawsuit") by executing the Three-Party Settlement Agreement and Mutual Release ("Agreement"), included here as Attachment 2 (Exhibit A), which will fully and finally settle the Lawsuit.
Presentation Information: Staff will be available for questions.
Staff Recommendation: Move that the Council approve the Resolution and authorize the City Manager to execute the Agreement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Resolution and authorize the City Manager to execute the Agreement.
2. Move that the Council not approve the Resolution and provide staff direction.
Background: After mediation and inclusion of a third-party through negotiations, the parties have reached terms of settlement. Notably, the Agreement does not require the City to pay any funds. However, both parties to the Lawsuit will drop all pending counts and all three parties agree to release the other parties.
Issues/Analysis: The specific terms of the settlement are contained in the Agreement. Notably, after the third-party makes payment to McTeague, McTeague and the City will file a joint notice of voluntary dismissal with prejudice of the Lawsuit.
