Executive Summary (General Business): The Upland Habitat Mitigation Fee is collected by the Planning and Zoning Department in accordance with Section 157.06. Native Upland Habitat Protection when a development cannot preserve upland habitat on site, or it is not practicable given the details of the project. This "Fee" is deposited into the Conservation Fund. The code specifies that the fee shall be updated via Ordinance, and the purpose of this Ordinance is to change the code to allow future updates to the "Fee" to be done via Resolution.

Presentation Information: Staff will be available to answer questions.

Staff Recommendation: Move that the Council approve the Ordinance.

1. Move that the Council amend the recommendation and approve the Ordinance.
2. Move that the Council provide directions and table the item.

Background: The Conservation Fund can be used for land acquisition, or for improvements to the conservation land properties, and/or public education. At the January 2025 workshop during the Conservation Lands Program update, the Council indicated support for staff's recommendations including the advancement of an agenda item to review and discuss an updated Upland Habitat Mitigation Fee. Staff would like to amend the fee via Resolution moving forward and as such this Ordinance needed to precede the agenda item proposing updates to the Upland Habitat Mitigation Fee.
