Executive Summary (General Business): Pivotal Utility Holdings, Inc. is requesting a ten (10) foot wide perpetual non-exclusive utility easement and a temporary construction easement for a gas pipeline.
Presentation Information: Staff will be available for questions.
Staff Recommendation: Move that the Council approve the perpetual non-exclusive utility easement and temporary construction easement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the easements.
2. Move that the Council not approve the easements and provide staff direction.
Background: Pivotal Utility Holdings, Inc. requires a perpetual non-exclusive utility easement on City owned property to construct, reconstruct, maintain, repair, replace and remove a pipeline for the transportation of gas connecting an existing underground gas main on Becker Road to a new transmission gas line south of the C-23 Canal. Additionally, a temporary construction easement to facilitate the initial construction of the pipeline is being requested.
Issues/Analysis: The proposed non-exclusive utility easement is necessary to provide Pivotal Utility Holdings, Inc. perpetual access to the subject property for the operation and maintenance of a gas pipeline. Additionally, a temporary construction easement is required during the initial construction of the pipeline.
Financial Information: There will be no cost incurred by the City.
