Executive Summary (General Business): Circle K Stores, Inc. desires to grant a perpetual non-exclusive sidewalk easement to the City for a sidewalk and associated lighting.

Staff Recommendation: Move that the Council approve the sidewalk easement.

Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the sidewalk easement.
2. Move that the Council not approve the sidewalk easement and provide staff direction.

Background: Circle K Stores, Inc. has constructed a service station on the SE corner of Crosstown Parkway and SW Fairgreen Road. Development of the site required the construction of a right turn lane from Crosstown Parkway into the site's driveway and relocating the existing sidewalk that is along the site's frontage on Crosstown Parkway. To maintain the 8-foot width of the sidewalk, a portion of the sidewalk was constructed on private property. Additionally, two existing street-light poles were relocated to the back of the sidewalk. The property owner therefore desires to grant a non-exclusive perpetual easement to the City for the sidewalk and street-lights.

Issues/Analysis: Approval of the resolution will accept the sidewalk easement for public use for the purpose of a sidewalk and lighting on the Grantor's property.

Financial Information: There is no cost to the City associated with accepting the sidewalk easement.

Special Consideration: Construction of the sidewalk is complete.

Location of Project: Crosstown Parkway, east of Fairgreen Road.
