Executive Summary (General Business): At the June 19, 2024 Special City Council Meeting, the Council directed City Manager Jesus Merejo and Human Resources to engage in negotiations with Interim City Attorney Richard Berrios to negotiate his terms of employment as City Attorney.

Presentation Information: Staff will be available to answer any questions the Council may have.

Staff Recommendation: Move that the Council authorize the Mayor, on behalf of the City Council, to execute the Employment Agreement.

Alternate Recommendations:
1. Move that the Council amend the recommendation and authorize the Mayor, on behalf of the City Council, to execute the Employment Agreement.
2. Move that the Council provide feedback.

Background: Pursuant to Council direction at the October 9, 2023 regular City Council Meeting, S. Renee Narloch & Associates was selected to conduct an executive search and recruitment for the position of City Attorney. Pursuant to Council direction at the February 26, 2024 City Council meeting, the Council voted to recommence the selection process and approved a 90-day extension for submission of applications. Thereafter, the Council narrowed the candidate pool and, on June 19, 2024, the Council selected Richard Berrios as the next City Attorney and directed the City Manager and Human Resources Director to negotiate the terms of the employment agreement with Mr. Berrios.

Issues/Analysis: N/A

Financial Information: Mr. Berrios shall be compensated at an annual rate of $230,000.00 payable in bi-weekly installments, as is consistent with the payroll policies for all City employees. Mr. Berrios shall also receive an automobile allowance of $600.00 per month.
