Summary Brief (Agreements/Contracts only)
1. Prepared by: Alaina Knofla, Acting Procurement Manager (PMD).
2. Parties: City of Port St. Lucie and Thor Guard, Inc.
3. Purpose: Provide advanced lightning predictive system for continued public safety awareness throughout Parks and Recreation Facilities to include parks, event spaces and interactive water features.
4. New/Renewal/Modified: New.
5. Duration: Initial term is for two (2) years with three (3) one (1) year renewal options.
6. Benefits to Port St. Lucie: Enables the City of Port St. Lucie Parks & Recreation Department to continue to improve, upgrade existing and new proposed lightning prediction systems to ensure continued safety to the public and youth organization sports group users at select park locations.
7. Cost to Port St. Lucie (Annual and Potential): Not to exceed $500,000.00 over full contract term including any renewal periods.

Staff Recommendation: Move that the Council waive formal bidding, per Chapter 35.08 (25) (a) (1) where the compatibility of equipment, accessories, or replacement parts is of paramount consideration, there are no commercially available substitutes for these components and/or replacement parts, which can only be purchased from the manufacturer or distributor (i.e., sole source).
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Sole Source Contract #20260055 for lightning prediction system.
2. Move that the Council not approve Sole Source Contract #20260055 and provide staff with direction.
