Executive Summary (General Business): The Planning and Zoning Department is in receipt of the signed Educational Facilities Impact Fee Credit Agreement ("Agreement") between Mattamy Palm Beach, LLC ("Mattamy") and the School Board of St. Lucie County, Florida ("School Board"). The agreement pertains to public school requirements of the Western Grove DRI. Mattamy and the School Board have requested the Joinder of the City to the Agreement, for the limited purpose of the City: (a)recognizing the educational impact fee credits; and (b) recognizing satisfaction of Western Grove DRI requirements regarding schools.

Presentation Information: No formal presentation. Staff will be available to answer any questions.

Staff Recommendation: Move that the Council sign the joinder page to the agreement.

Alternate Recommendations:
1. Move that the Council amend the recommendation and sign the joinder page to the agreement.
2. Move that the Council not sign the joinder page to the agreement and provide staff direction.

Background: Condition 58 of the Western Grove DRI (Resolution 21-R06) requires a development agreement between Mattamy and the School Board for the dedication of one K-8 school site. The Agreement provides for a formula for the reimbursement of educational impact fees that would normally be assessed of dwelling units within the proposed development as well as conveyance of the required school site to the School Board.
