Executive Summary (General Business): This Termination of the Amended and Restated Restrictive Covenant is being submitted so that the lots comprising of the subject property may be conveyed, devised, or developed independently

Staff Recommendation: Move that the Council Council approve the requested for the Termination of Amended and Restated Restrictive Covenant.

Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the requested Termination of Amended and Restated Restrictive Covenant.
2. Move that the Council deny the recommendation and provide staff direction.

Background: On July 12, 2018, Bruno Scaccia and Paola J. Scaccia (the "Owners") executed an Amended and Restated Restrictive Covenant relative to Lots 13 and 14, Block 341, Port St. Lucie Section Twenty-Five. The Amended and Restated Restrictive Covenant encumbered Lots 13 and 14 so that they would be assessed as a single residential unit.

Issues/Analysis: The Owners now wish to convey, devise, or develop Lot 13 independently of Lot 14. The total amount of assessments owed to the City have been paid in full. The Amended and Restated Restrictive Covenant may now be released, satisfied, and discharged in its entirety, and a Termination of the Amended and Restated Restrictive Covenant shall be recorded with the St. Lucie County Clerk.
