Executive Summary (General Business): This ordinance amends Chapter 36 of the City’s Code of Ordinances to provide that fees authorized under the City Code may be adopted by resolution, unless otherwise required or prohibited by law. The ordinance establishes a consistent process for the adoption and future modification of City fees.

Presentation Information: Staff will be available to answer questions.

Background: City fees are currently established through a combination of ordinances and resolutions. Certain fee schedules are codified directly within the City’s Code of Ordinances, while others, including Planning and Zoning fees, have historically been adopted by resolution. When fees are established directly by ordinance, any addition, removal, or modification of a fee requires an amendment to the Code through the ordinance process. Additionally, the City Code does not currently contain a general provision authorizing City fees to be established by resolution. The proposed amendment to Chapter 36 addresses this by providing that, unless otherwise required or prohibited by law, fees authorized under the City Code may be adopted by resolution.
