Executive Summary (General Business): In early July 2023, a 200' section of the Riverwalk Boardwalk South received major fire damage created by an undetermined source causing the Boardwalk to be closed to the public due to its compromised structure. Staff has been working with our insurance provider and has developed the scope of work and determined an action plan to correct the damaged areas and restore the Boardwalk back to a safe, contiguous pathway. Once repaired, the Boardwalk will be fully accessible extending from Bridge Plaza to Pioneer Park.

Staff Recommendation: Move that the Council approve waiving the bidding, per Chapter 35.08(c), good cause shown, and approve the one-time purchase to repair the Riverwalk Boardwalk South damaged section at the Port District-Pioneer Park. If approved, the City will enter into a contract with Brothers' Construction, Inc., the original contractor who constructed the Boardwalk, in the amount of $726,980.00. The ensuing work is estimated to be completed by the second week of March 2024.

Alternate Recommendations:
1. Move that the Council amend the recommendation and approve, with good cause shown, the necessary emergency repairs to the Riverwalk Boardwalk South damaged section.
2. Move that the Council not approve the emergency repairs and provide staff with direction.

Background: Emergency repairs are needed to repair fire damage created from an undetermined source dating to July 2023. Damage to the Riverwalk Boardwalk South has caused the City to close portions of the Boardwalk and restrict public access for over four months.
