Executive Summary (General Business): The City has received an application to amend the annexation agreement for the property known as Founder’s Crossing. Founder’s Crossing is approximately 386 acres in size and located on the south side of Midway Road at the intersection of McCarty Road and Midway Road. The subject property was annexed into the City in January 2004 (OR 04-09) by Kenco Communities. An annexation agreement was approved that provides for 875 residential dwelling units, 290,000 square feet of commercial, retail, professional office and or institutional use. The property was purchased by Founder’s Crossing, LLC. Founders Crossing, LLC, has applied for a future land use map amendment (P25-113), an amendment to the Founder’s Crossing PUD (P25-130) and an amendment to the annexation agreement based on a revised development plan for the property. The development entitlements are not proposed to change.

Staff Recommendation: Move that the Council approve the amendment to the Founder’s Crossing, LLC, annexation agreement.
Alternate Recommendations:
Move that the Council amend the recommendation and approve the amendment to the annexation agreement.
Move that the Council not approve and provide staff direction.
Background: The proposed changes to the annexation agreement update the requirements for utilities, stormwater and roadway improvements.
