Approve Mattamy Homes Right of Entry License Agreement for the Tradition Regional Park Site

Executive Summary (General Business): Approval of the attached agreement will grant legal access to the Tradition Regional Park site to Mattamy Homes representatives. Said access will be for the purpose of preliminary inspections, investigations, and site work while a more comprehensive agreement relating to the park construction is being negotiated.

Staff Recommendation: Move that the Council approve the attached License Agreement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the attached Right of Entry License Agreement with revisions.
2. Move that the Council not approve the Right of Entry License Agreement and provide staff with further direction.
Background: Mattamy Homes, in partnership with the City of Port St. Lucie, developed a conceptual master plan design, phasing recommendations and is working towards commencing Phase I construction of Tradition Regional Park.
On April 19, 2021, at the Special City Council meeting, City Council conceptually approved the master plan for Tradition Regional Park. Additional direction was given for Mattamy Homes, to initiate construction drawings for "Phase I" development of the park, to include four baseball fields, four softball fields, three soccer/multipurpose fields along with ancillary support facilities such as parking, restrooms, and lighting.
