Background: On August 24, 1994, Rudolpho Gonzalez and Mavis M. Gonzalez executed a Restrictive Covenant relative Lots 9 and 20, Block 169, Port St. Lucie Section Four. The Restrictive Covenant encumbers Lots 9 and 20, so that the lots would be assessed as a single residential unit.
Issues/Analysis: Rudolpho Gonzalez, an unremarried widower, conveyed the subject properties to Rudolpho J. Gonzalez, as Trustee of the Rudolpho J. Gonzalez Revocable Trust Agreement dated February 5, 2019 (the "Current Owner"). The Current Owner now wishes to convey, devise, or develop Lot 9 independently of Lot 20. The total amount of assessments owed to the City have been paid in full. The Restrictive Covenant may now be released, satisfied, and discharged in its entirety, and a Termination of Restrictive Covenant shall be recorded with the St. Lucie County Clerk.
