2. Parties: City of Port St. Lucie and Ferguson Waterworks Inc, a Florida profit corporation.
3. Purpose: The USD is seeking to waive the bidding for acquisition of materials for the Naranja Area Sewer improvements to acquire materials from Ferguson Waterworks, Inc. Felix Associates of Florida, Inc. has agreed to provide the work once materials are received pursuant to Contract #20200043.
4. New/Renewal/Modified: New

6. Benefits to Port St. Lucie: Repairs to City's wastewater system.
7. Cost to Port St. Lucie (Annual and Potential): Estimated cost of $74,768.60 for materials for Phase I and $24,040.12 for Phase II, for a total estimated cost of $98,808.72.

Staff Recommendation: Move that the Council waive bidding, per Chapter 35.04(c) of the City's code of ordinances, for good cause shown and approve the immediate purchase of materials from Ferguson Waterworks needed for immediate repairs to the Naranja and RiverPark area wastewater system.

Alternate Recommendations:
1. Move that the Council amend the recommendation and complete the motion in the affirmative.
2. Move that the Council not approve and provide staff with direction.

Background: The COVID pandemic has impacted the USD in many ways - one of the largest impacts are to staff and materials shortages resulting in current City contracts and contractors unable to honor pricing.
