Resolution 23-R130, Conveying Flowage Easements and Deed for Becker Road Construction and Plats

Executive Summary: The temporary flowage easements from 3 developers are needed to allow the drainage from Becker Road to flow offsite until such time as a permanent flowage easement is recorded providing surface water drainage for Becker Road. The deed is conveying to the City the portion of Becker Road running through the existing FPL easement.
Presentation Information: Questions will be answered upon request.
Staff Recommendation: Move that the Council accepts the resolution conveying the flowage easements and deed for the Becker Road Construction and Plats.
Alternate Recommendations:
1. Move that the Council amend the recommendation and accept the Resolution of approval of flowage easements and deed for Becker Road Construction and Plats.
2. Move that the Council not approve the Resolution and provide staff direction.
Background: Becker Road between Village Parkway and Range Line Road is currently under construction between 3 developers. Each developer has provided a temporary drainage easement for the conveyance of surface water until such time as a permanent easement is put in place. The submitted deed is the piece of Becker Road that converses the FPL Easement within the Wilson Grove Property.
Issues/Analysis: Future plat development with dedication of permanent flowage easements surrounding the Becker Road Right-of-Way will automatically terminate the temporary flowage easements.
Financial Information: There will be no cost incurred by the City.
Special Consideration: The temporary flowage easements and deed are critical for the function of the Becker Road design already under construction.
