Ordinance 25-35, Public Hearing, Authorizing the Conveyance of a Drainage Easement in Favor of LTC Ranch West Residential Community Development District
body
Submitted By: Margaret Carland, Senior Deputy City Attorney

Strategic Plan Link: The City's Goal of high-quality infrastructure and facilities.

Executive Summary (General Business): This Drainage Easement Agreement is being conveyed to the LTC Ranch West Residential CDD ("CDD") so it can drain surface water from the lands within the PUD known as LTC Ranch (West) Residential PUD, in accordance with all applicable SFWMD permits.

Presentation Information: Staff will be available to answer any questions.

Staff Recommendation: Move that the Council approve the Ordinance authorizing the conveyance of the Drainage Easement, pursuant to the Drainage Easement Agreement, in favor of LTC Ranch West Residential Community Development District.

Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Ordinance authorizing the conveyance of the Drainage Easement, pursuant to the Drainage Easement Agreement, in favor of LTC Ranch West Residential Community Development District.
2. Move that the Council not approve and provide Staff with direction.

Background: In April of 2025, Midway Glades Developers, LLC ("Developer"), conveyed the property that will be subject to the drainage easement to the City. Prior to the conveyance of the property to the City, the Developer was suppose to convey this drainage easement to the CDD. The drainage easement agreement, however, was inadvertently recorded after the deed conveying the property to the City. Therefore, the Developer requested that the City convey the drainage easement to the CDD.
