Staff Recommendation: Move that the Council waive the bidding, per Chapter 35.04(c), and award the Contract #20230117 to Johnson, Mirmiran & Thomson, Inc. for the CEI and Geotech Services for the Port St. Lucie Blvd. Segment 3 Construction Project.

Alternate Recommendations:
1. Move that the Council amend the recommendation and award Contract #20230117.
2. Move that the Council not approve Contract #20230117 and provide staff with direction.

Background: The City Council awarded this project to CONSOR Engineers, LLC on April 26, 2021. As of August 1, 2023, CONSOR Engineers, LLC acquired American Consulting Professionals, LLC, the Designer of the project. Per the terms of the TRIP Agreement with the Florida Department of Transportation (FDOT) and the contract with the City of Port St. Lucie, this acquisition has created a conflict of interest between the Designer and the CEI.
