Executive Summary (General Business): This request is for an amendment to the dedication imposed upon Tract R2 via Riverland Parcel B, Plat One (see Exhibit "A"). Currently Tract R2 is dedicated in favor of the Developer for recreational purposes. The Developer desires to modify the dedication, to instead, provide dedication in favor of the Developer for future development purposes to facilitate access to the Developer's model center.

Presentation Information: No presentation will be provided.

Staff Recommendation: Move that the Council approve the agreement as attached.

Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the agreement.
2. Move that the Council not approve the agreement and provide direction.

Background: The Riverland Parcel B Model Row and Sales Center Site Plan (P21-120)("Site Plan"), see Exhibit "B", is currently accessed from the private ROW known as, SW Sea Jewel Boulevard. The Developer desires to amend the Site Plan to provide a temporary access driveway within, Tract R2, from Community Boulevard to the private ROW known as Oyster Bay Road. This will become the customer access for the model center until the model center is no longer needed and is removed.

Issues/Analysis: The amendment is necessary because a driveway cannot be constructed through R2 with the current dedication language as the language restricts R2 to recreational uses. The driveway will be closed after the model center is removed and the lots are sold or build for the intended final residential use.
