Strategic Plan Link: The City's Goal of high-quality infrastructure and facilities.

Executive Summary (General Business): The third phase of the Midway Road Improvements project from Selvitz Road west to Glades Cut-off Road is being managed Florida Department of Transportation (FDOT) but will ultimately be owned and maintained by St. Lucie County. The design of the project is estimated to be completed February 2020.  Funding for right-of way acquisition is programmed in 2019. Construction is currently unfunded. The City and County will need to enter into an Interlocal Agreement to formalize the details. The Interlocal Agreement requires the City to convey fee simple title to certain real property as well as requires the City to convey a temporary construction easement, a permanent construction/maintenance easement and a permanent drainage easement.

Presentation Information: Frank Knott (if requested, 5 minutes)

Staff Recommendation: Move that the Council approve the ordinance and authorize execution of the agreement along with conveyance of parcels and easements necessary to complete the project.

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and complete motion in the affirmative.

2.                     Move that the Council provide staff direction

Background: On April 28, 2014, the City Council authorized the City Manager to enter into an agreement with St. Lucie County which set forth the obligations and responsibilities of the City and the County regarding the implementation of the construction of the first phase of the Midway Road improvement project (attached).   The third phase will require a similar agreement with the County. The projects are similar in nature: closed drainage system in lieu of the open channel (ditch), buffer residential property from the road via landscape planting, relocation of City utilities, improvements to City roads that intersect Midway Road, and median landscaping utilizing the City’s palette. There are several City owned properties that are impacted by the drainage system and the landscape buffer relating to the project. The Interlocal Agreement contemplates conveyance of certain real property and easement rights to the County. For Parcel 101, fee simple title will be conveyed to the County to be used as a landscape buffer and is the proposed site for a pond. Parcel 700 will involve conveyance of a temporary construction easement in favor of the County for the installation of a landscape buffer. Regarding Parcel 800, the City will convey a permanent easement to the County for the removal of a ditch, construction and installation of a box culvert as well as maintenance of the roadway and drainage system. Parcel 804 will involve conveyance of a permanent drainage easement in favor of the County to accommodate drainage to an existing pond. FDOT is managing all aspects of the project, from design through construction. In an effort to reduce overall project costs, FDOT has requested that the City parcels and easements be donated to the County.

Issues/Analysis: The expected result of the project will be a “gateway” enhancement for the northern City limits.
