Executive Summary (General Business): The Third Amendment to the Lease Agreement between the City and SL Family Recreational CNT, LLC, a Florida limited liability company ("Lessee") for 7 acres of City-owned real property for use as a Paintball Park expires on January 25, 2020 unless the City renews or otherwise extends the Lease. The option to renew (pursuant to the Third Amendment) is five years, and Mr. Cloe has expressed an interest in extending the term.

Presentation Information: The City Attorney's Office and Parks and Recreation will provide a brief powerpoint detailing the terms of the lease and provide pictures of the property to the Council.

Staff Recommendation: Request that the Council consider extending the Lease for an additional term.

Background: On January 28, 2009, the City and Lessee entered into a Lease Agreement for the use of City-owned real property as a Paintball Park located at 2221 SW Del Rio Blvd., located South of Crosstown, East of 95. Lessee occupies approximately 7 acres of real property and pays the City $500 per month and is responsible to maintain required insurance. Lessee operates as a for-profit entity. Lessee is required to seek written authorization by the City prior to expanding on any additional use of the property. As part of the Third Amendment, Lessee is authorized to occupy space as an RC (Radio-Controlled) cars; however, Lessee has not exercised that option. Lessee occupies the space with two separate paintball parks and has operated hayrides and other activities.

Issues/Analysis: Lessee has requested an extension of the Lease in writing pursuant to the terms of the Lease Agreement.
