Executive Summary: On Tuesday March 26, 2024, the applicant has officially withdrawn the variance of 4.3 feet to allow a 1.7-foot setback from the side property line, whereas a 6-foot side yard setback is required for any driveway. Section 158.217(c)(2)(n) of the Zoning Code requires a minimum setback of six (6) feet from the side property for driveways in the RE (Estate Residential) zoning district.

 

Background: The Planning & Zoning Board tabled the application on March 5, 2024, to the April 2, 2024, board meeting to allow the applicant and surrounding property owners time to provide further information. On Tuesday March 26, 2024, the applicant has officially withdrawn the variance application.
